General Terms and Conditions (GTC)

1. Scope
These Terms and Conditions apply to all bookings of hotel stays, activities and services through Karthago Commercial Broker LLC (hereinafter "Provider"). By booking, guests expressly accept these Terms and Conditions.
2. Limitation of liability for hotel stays
(1) The provider is liable within the framework of the hotel operation exclusively for damages that
based on gross negligence or intent on the part of the provider or his vicarious agents,
arise directly from the violation of essential contractual obligations (e.g. accommodation, security within the hotel complex).
(2) Liability for slight negligence is excluded unless it involves personal injury or damage resulting from the breach of vital contractual obligations.
3. Disclaimer of Liability for Partner Services & Activities
(1) The provider arranges activities (e.g. tours, yoga, hot air balloon rides) in cooperation with external partners. The provider assumes no liability for these third-party services, in particular not for:
Damage caused by misconduct of partners (e.g. accidents, inadequate safety standards),
Cancellation of activities due to weather, technical problems or force majeure,
Dissatisfaction with the quality of partner services.
(2) The partners act as independent contractual partners. Claims must be asserted directly with the respective provider.
4. Liability for luggage & valuables
(1) The hotel is not liable for theft, loss or damage to luggage or valuables in the hotel rooms, unless the damage was caused intentionally or through gross negligence by the hotel staff.
(2) Guests are requested to deposit valuables in the reception safe.
5. Guests' obligation to cooperate

In case of health restrictions (e.g. for activities) the provider must be informed in advance.
6. Severability Clause
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
7. Place of jurisdiction & applicable law
(1) Any dispute shall be governed by the laws of the United Arab Emirates or Tunisia [adapted depending on the place of business].
(2) The place of jurisdiction is Dubai, UAE.
